摘 要:
将特别权力关系理论作为司法介入体育自治问题的理论依据进行了基础性阐述，并分析了这一理论在体育自治领域的适用可能。进而，对司法不得介入的理由和司法得以介入的理由分别进行了初步论证，既从反面分析了国内现阶段的相关立法缺陷和机制冲突，也从正面阐述了在国内法治发展和国际趋势推动的前提下司法介入体育纠纷的必要性和可能性。[著者文摘]

Analysis on the Difficulties and Reasons of Judicial intervention of Sports Dispute

Abstract:
The positive and negative reason for judicial intervention in sports autonomy, mainly in sports dispute, concentratively issues in the Article. Firstly, with Basic exposition of the theory of Das besondere Gewaltverhaltnis which is the theoretical foundation of judicial intervention, we hold that the theory in the field of sports autonomy is suitable and possible. Secondly, makes a respectively argument for the reasons that justice could intervene in the sports dispute and that could not, then analyses the relevant legislative defect in domestic now and conflict with mechanism from reverse side already, from positive side to explain the development of rule- by - law at home and necessity and possibility for judicial review in sports dispute under the prerequisite of globalization too.[著者文摘]
