摘 要:
在现实中存在大量因家庭暴力严重损害妇女身心健康的事件,施暴者由于现行法律规范的不完善,往往不能得到有效的制裁,而不堪忍受长期家庭暴力愤而杀夫的妇女如何定罪处罚,在司法实践中出现了“不同法院同罪不同判”的情况,这些情况的出现,不利于司法统一,也不利于平等地保护公民的合法权益,因此加大对妇女暴力实施者的惩处力度刻不容缓。[著者文摘]

Abstract:
There is a great deal of domestic violence existing in real life, which is extremely hannful to both physical and mental health of women. However, the punishment to the offenders often can not be carried out properly due to the deficiency of existing law. For example, there are such cases as ＂ different judgment on the same guilt by different courts＂ existing in the conviction to women who killed their husband because they could not bear the unceasing domestic violence. This is against the unification of justice, also against the equality of protecting legal rights of the citizens. Therefore, it is essential to reinforce the punishment on violence against women.[著者文摘]
