摘 要:
从横向来看，权利能力的起源与发展体现了人的解放过程，权利能力也使人与动物相区别。从纵向来看，二元存在、自我意识、表示意志和现世性是其存在理由。以“纯利益权利能力附停止条件说”和“利益关联说”解决未出生者的民法地位问题，以“近亲属利益关联说”解决死者的民法地位问题，使权利能力始于出生、终于死亡这一通说得以维持，有利于民法体系的稳定。[著者文摘]

Abstract:
Synchronically, the origin and development of right capacity embody the course of man＇s emancipation, thus distinguishing man from the animal. Diachronically, binary existence, self- consciousness, will expression and worldliness are the very reasons for its existence..
