摘 要:
《国际合同使用电子通信公约》于2005年11月在联合国大会上决议通过，它是有关电子商务的第一个专门性公约，也是近年来国际商事立法最重要的成果。公约的目的是采用统一规则消除对国际合同使用电子通信的障碍，也确立了媒介和技术选择自由、不偏重任何技术及功能等同原则。在解读公约的主要条款的基础上对公约的先进性、科学性及局限性做了立法评价。[著者文摘]
