摘 要:
根据浙江、福建两省调研的实际情况，针对林改中的一些政策观点和实际做法，分析林权流转的前提条件：一是林业产权清晰；二是具备林权流转的市场。分析林权流转市场存在的问题：国家允不允许林权流转；林权流转是否需要国家政策规范；林权流转市场平台的建立是否需要政府促建。对于国家是否允许林权流转，主要分析林权流转中存在的可能会限制林权流转的观点或者政策性原则，例如防止林农失地原则。对于国家政策规范林权流转的问题，提出国家政策应该体现林权流转中的“公私”领域。对于地方政府是否应该促建林权流转市场平台，提出是由不同地区的市场经济发育程度所决定，地方政府应该根据自己的实情而决定是否需要促建林权流转的市场平台。[著者文摘]

On the Precondition of Forest Property Right Business

Abstract:
According to the Zhejiang and Fujian province＇ s fact of the forest reform, The author think that the precondition of the forest property right business includes two sides： one is that the forest property right must be perspicuity; the other is that there should be the forest property right business market： There are three questions of the forest property right business market： the first is that the forest property right business is forbidden by the state or not; and the second is that policies of the forest property right business are enacted by the state or not; and the third is that the state help to build the forest property right business market or not. the author analyses the viewpoints which are possible to restrict the forest property right business for the first. The author thinks that the state should administer the forest property-right business by the policies according to the public or personal＇ s field for the second. For the third question, the author considers that the different local government builds the forest property right business market according to their own fact.[著者文摘]
