摘 要:
在中国法学论者根据各自的立场而形成的两种截然不同且针锋相对的全球化对策当中，隐含着一个共同的关于全球化或法律全球化是一种整体化的和同质化进程的理论预设。这一共同的理论预设在本质上把全球化视为一元的、目的论的整体性规划；它将全球化或法律全球化化约成以线性发展为唯一时间观的“现代化”本身；还从一个更深的层面上表现出了一种“认知谬误”，即把全球化或法律全球化与同质化本身等而视之。这一同质化的理论预设忽略和遮蔽了作为一种矛盾且多元的全球化进程。全球化不是单一化、同质化，而是一个相反相成的过程，是单一化与多样化、国际化与本土化、一体化与碎裂化、集中化与分散化的统一。[著者文摘]

Globalization as A Contradictory and Pluralistic Process： A Criticism on Homogenization-Presupposition of ＂Argumentation on Globalization＂ in Chinese Legal Science

Abstract:
There is a theoretic presupposition of globalization or globalization of law as a holistic and homogenous process in the different countermeasures proposed by Chinese scholars with as their theoretical basis their different standpoints, This common theoretic presupposition in essence views globalization as a unitary, methodological and holistic program, it equates globalization or the globalization of law as ＂modernization＂ per se with its linear conception of time and in a deeper sense it also harbors the ＂cognitive fallacy＂ of regarding globalization or the globalization of law as homogenization itself. Globalization does not simply mean homogenization but rather a rich and complex process, a contradictory combination of homogenization and diversity, internationalization and localization, integration and fragmentation, and centralization and decentralization.[著者文摘]
