摘 要:
香港特别行政区有关版权的法律依据主要源自香港法例第528章《版权条例》。新的《版权条例》于1997年订立，过去数年，随着时代的变迁，科技发展一日千里，侵犯版权的形式愈见层出不穷，加上社会各界对保障知识产权的意识日渐提高，香港特区政府当局曾多次修订条例的涵盖范围、若干罪行的定义，以及相关的罚则。修例的目的，不但是要平衡版权拥有人、社会大众及版权作品业务使用者的利益，亦须履行香港特别行政区在遵从世界贸易组织《与贸易有关的知识产权协议》的规定方面的国际责任。这些法例修订工作也表明了香港特区政府打击侵权罪行的决心，并一再彰显其对保障知识产权工作的高度重视。[著者文摘]

The Introduction on Anti-infringement Copyright Crime in Hong Kong

Abstract:
The legal basis of copyright in The Hong Kong Special Administrative Region mainly comes from the Hong Kong legal regulation 528th chapter ＂Copyright Rule＂. Several years has passed since New ＂Copyright Rule＂ worked out in 1997. Along with time vicissitude and the very fast development of technological progress. Infringement copyright＇ s form emerges one after another incessantly, in addition the community to safeguards the intellectual property rights consciousness to enhance day after day. The Government of The Hong Kong Special Administrative Region authority once revised the rule the covering scope, certain crime＇ s definition, as well as related penal regulations many times. The goal of revision law, is not only must balance the copyright owner, the social populace and the copyright work service user＇s benefit, must fulfill the Hong Kong Special Administrative Region in the deference World Trade Organization ＂And Trade Related Intellectual property rights Agreement＂ stipulation aspect international responsibility. These legal regulation revision works had also indicated The Government of The Hong Kong Special Administrative Region attacks the right infringement crime＇s determination, and shows it to safeguard the intellectual property rights work repeatedly to take seriously.
