摘 要:
村民自治制度是我国宪法规定的具有中国特色的基层自治制度，是区别于主权自治和地方自治的基层社会自治。村民自治制度是国家和社会二元化权力发展的要求和结果，体现了中国宪法中国家与社会互相分权的发展趋势；落实了人民主权的宪政理念，体现了我国社会主义民主的性质；实践了宪法上的人权原则，保障公民基本权利的实现。村民自治权具有宪法基本权利的属性，应在宪法中明确村民自治的宪法地位与村民自治权的基本权利性质，并制定出关于村民自治的《村民自治法》。[著者文摘]

Improvement in Lawmaking of Villagers＇ Self-Government System in Constitutional Perspective

Abstract:
Villagers＇ self-government system is a grass-roots self-government system of Chinese characteristics specified in our Constitution, which distinguishes grass-roots society from self-government of dominion autonomy and local autonomy. Villagers＇ self-government system is the requirement and outcome of both national and social development and it reflects developmental trend of China＇s Constitution in the decentralization of authority of nation and society; carries out constitutional logos for the people＇s sovereignty, embodies socialist democracy character of our country, and it fulfils human rights principle in Constitution and guarantees the realization of basic citizen rightS. The villagers＇ self-government is of attribute of the basic rights in Constitutional, so the constitutional position of the villagers＇ self-government system and the characters of their basic self-government rights should be defined in Constitution, and a ＂villagers＇ self-government law＂ regarding villager self-government should be worked out.[著者文摘]
