摘 要:
司法解释在理论上与立法同属中国国际私法的法源，从制度设计上讲，两者本应处于互动与耦合状态。然而，长期以来，部分司法解释超越立法已是不争的事实，本文拟就导致部分涉及国际私法内容的司法解释与现行立法“脱耦”这一现象的内在原因作一学理分析，提出若干值得反思的问题，并就促进两者的耦合，进而推动中国国际私法的和谐发展提出若干建议，[著者文摘]

Theoretically speaking, judicial interpretations and legislation equally belong to sources of China＇s private international law.
