摘 要:
“人”的问题是各个部门法的首要问题。各个民法典的基本概念及其基本价值观，都是以关于人的某种特定的观念为出发点的。对从古罗马法到现代民法中的“人”及其人性问题进行历史的探讨，以及对现时代的诸国市民法中的人性问题进行分析，可以得出“平等而理性的人”的民法共识并不是从古至今就融入民法，也并不是放诸四海皆准的“真理”，它仅仅是一种假设的结论。在此基础上对民法中的“人像”从理论上进行了较全面的描述，并指出了现代民法对这一问题应该采取的态度。[著者文摘]

Abstract:
The issues about ＂person＂ are the most important questions in every law. The basic concepts and principles in every civil code are stemmed from the special prospects about ＂person＂. This essay not only analyses the academic history about pei＇son and humanity from Roman Law to modem civil law, but also the issues about humanity in the nowadays civil cde of some countries. Then the author gets the conclusion that： the persons in civil law are equal and reasonable which is the commonsense in this subject is just a premise not an absolute truth. Based on this, this essay describes the characteristics of the person in civil law ＂comprehensively and points out the attitude the modem civil law should take.[著者文摘]
