试析外观设计相近似性的判断主体

摘  要:

我国法律的相关规定及在审查实践中的分歧在外观设计专利无效宣告案件的审查实践中,经常涉及到对外观设计相同相近似性的判断,对于其判断主体,1993年《审查指南》规定为“一般购买者”,2001年《审查指南》修改规定为“一般消费者”,并在2006年《审查指南》中得到沿袭。具体规定是:在判断外观设计是否相同或相近似时,应当基于被比设计产品的一般消费者的知识水平和认知能力进行评价。[第一段]

Abstract:

Relevant Chinese law provisions and divided views in examination practice The examination of cases of design patent invalidation often involves determination of design identity or similarity. Under the Guidelines for Examination as of 1993,the sub- jects or those from whose perspective the determination is made are the"average buyers".In the Guidelines for Exam- ination as of 2001,they were changed into the"average consumers".The specific provision of the Guidelines for Examination as of 2006 goes like this:"the determination of design identity or similarity shall be made according to the knowledge and cognitive capability of an average consumer of the product incorporating the design being examined. Different kinds of design patent products have different consumers... having common knowledge of the designs incorporated in the same or similar products as that incorporating the design being examined."[第一段]
