广告代言人的法律地位及其责任

摘  要:

广告代言人是与广告主、广告经营者、广告发布者地位平等的广告主体。广告代言人代言虚假广告应承担相应的民事责任、行政责任和刑事责任。为了弥补我国广告代言人制度存在的缺失,应在《广告法》中专门设立广告代言人法律制度,尤其是对广告代言人的法律责任应做出明确的规定。[著者文摘]

The Advertising Advocate's Legal Status and Law Responsibility

Abstract:

In the advertising campaign, the advertising advocate is an important participant who is equal to advertiser, advertising agent, and advertising promulgator in legal status. The advertising advocate should be assumed with civil responsibility, administrative responsibility and criminal responsibility for participating a false advertising campaign, in order to protect consumers' legal fights and interests and preserve the competitive order of domestic market. Because of the lack of the advertising advocate system currently, our country should establish the specialized advertising law system, absorbing the adjustment category of Advertisement Law and regulating definitely the advertising advocate' s law responsibility particularly.[著者文摘]
